1. Agreement to these terms

These Terms of Use are a legally binding agreement between you and the Trustee for 4 Good Unit Trust (ABN 85 145 868 031) trading as The Thompson Method ("we", "us", "our"), based in Queensland, Australia.

They govern your use of the Infant Feeding Index website at infantfeedingindex.com - including the landing page, the thank-you page, and the optional email subscription offered there. By using the site or subscribing to our list, you agree to these terms and to our Privacy Policy.

The Infant Feeding Index survey itself runs on a separate site (survey.infantfeedingindex.com) and is governed by its own Survey Terms of Use and Survey Privacy Policy. These Terms of Use do not cover the survey.

2. Who can use this site and subscribe

You must be at least 18 years old and capable of entering a binding contract to subscribe to our email list. The site itself is open to general visitors.

3. The Infant Feeding Index, in brief

The Infant Feeding Index ("the Index") is a living, real-world dataset of how mothers around the world experience pregnancy, birth and infant feeding. It exists to make the systemic gaps in maternal care visible to governments, hospitals, insurers, researchers and the public.

The Index is built from anonymous survey responses contributed by mothers around the world. Aggregated findings are published through this site, through partner channels, and through the email list described below. The Index is not a clinical trial or medical service, and the content we publish is not personalised medical advice. Please speak with a qualified health professional about any concerns specific to you or your baby.

4. Subscribing to the email list

After completing the Index survey, you'll be redirected to a thank-you page on this site. There you can choose to give us your email address to receive updates.

By subscribing, you're consenting to receive:

Index findings, reports and updates - the published outcomes of the work the Index makes possible;
information about The Thompson Method's related programs - including My Milk Map, our other services, courses, and offers that may be relevant to your interest in maternal and infant feeding support.

We aim to keep the email frequency reasonable and the content valuable. You can unsubscribe at any time via the unsubscribe link in every email, or by contacting us at hello@infantfeedingindex.com.

A note on operational reality. During an initial period, emails to Index subscribers will come from The Thompson Method and be sent from our existing list infrastructure (Kajabi). We are in the process of transitioning to dedicated infantfeedingindex.com infrastructure (GoHighLevel). The substance of what you're agreeing to is the same regardless of which system delivers the email; our Privacy Policy describes both providers.

5. The survey is separate from the email list

This is important enough to call out in the terms as well as the Privacy Policy: the Index survey is anonymous. We do not collect your name, email, or any identifier during the survey. If you choose to subscribe to our email list on the thank-you page, that email is stored in a system entirely disconnected from your survey responses. There is no join key, no shared timestamp, and no technical pathway between the two. We cannot match your subscription to any survey you may have completed, and neither can anyone else.

Practical consequences:

Updating or unsubscribing from your email record has no effect on any survey responses you may have submitted.
You cannot ask us to retrieve, correct or delete a specific survey response by giving us your email - there is no way for us to find it.
The architectural separation is intentional and is the central privacy promise of the Index.

6. Acceptable use of this site and the email list

You agree not to:

use the site or the email list unlawfully or to harm others;
submit a subscription using an email address you do not control, or impersonate another person;
attempt to access non-public parts of our systems, scrape the site, or interfere with its operation;
reverse-engineer the Index methodology or use our content in ways outside the licence in Section 7; or
use our trade marks without permission.

We may suspend or remove access (including removing you from the list) for conduct that breaches these terms.

7. Our intellectual property

The Infant Feeding Index - including its design, methodology, metrics, reports, dashboards, software, brand, and the content of our emails - is owned by us and protected by intellectual property laws. You may read, share and quote from publicly released Index materials for non-commercial purposes with attribution. Any commercial use, reproduction of the methodology, or use of our trade marks requires our prior written permission.

Names including The Infant Feeding Index, Intention-Gap, Robyn Factor, The Thompson Method, My Milk Map, and associated logos are trade marks of the Trustee for 4 Good Unit Trust.

8. Disclaimers

The site, the email list, and the Index content are provided "as is" and for educational and research purposes. While we apply care in how we research, write and publish, we make no warranties that any specific Index finding will apply to your individual circumstances. Index content is not personalised medical, lactation, nursing or other professional advice, and is not a substitute for advice from a qualified health professional who knows your situation.

Nothing in these terms excludes any consumer or statutory right you have under the laws of your country that cannot lawfully be excluded - including, for Australian users, the consumer guarantees under the Australian Consumer Law.

9. No warranties; your statutory rights

The site and the email list are provided in good faith for educational and research purposes. We make no warranties about findings, recommendations, or the experience of subscribing. Nothing in these terms affects any rights you have under privacy law, consumer law or other legislation in your country that cannot lawfully be excluded.

10. Changes to the site, the list, or these terms

We may change, suspend or discontinue the site, the email list, or any feature at any time. Where we make a material change to these terms or to how we use subscriber data, we will publish the updated version at this page and notify subscribers by email at least 14 days before the change takes effect. Continued use of the site, or remaining on the list after the effective date, constitutes acceptance of the change. If you don't agree, you can unsubscribe before the change takes effect.

11. Governing law

These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland. If you use the site from outside Australia, you may also have rights and remedies under the laws of your country, which these terms do not override.

12. General

Entire agreement. These terms, the Privacy Policy, and any specific terms presented when you sign up to receive emails form the entire agreement between us regarding this site and the email list.
Severability. If any provision is found invalid, the remainder continues in effect.
No waiver. A failure to enforce a provision is not a waiver of it.
Assignment. You may not assign these terms. We may assign them as part of a business restructure or sale, with the protections in our Privacy Policy continuing to apply.
